These terms govern your use of the 360paymentech.com website and your relationship with 360 Paymentech as a merchant, partner, or visitor.

Important: The payment-processing services described here are governed separately by your Merchant Agreement and Program Guide. These Terms cover general use of this website and our service relationship. If there is a conflict between these Terms and your signed Merchant Agreement, the Merchant Agreement controls.

1. Who we are

360 Paymentech is a payment-processing company and authorized reseller operating in the United States. We provide payment acceptance, dual-pricing programs, equipment, gateway services, ACH, cash advance, ATM placement, and related business services. Our AI division, 360 AI, provides technology services including AI receptionists, marketing automation, websites, CRM, and related tools. References to "360 Paymentech," "we," "us," or "our" include both the payment services and the 360 AI division.

2. Use of this website

By accessing 360paymentech.com (the "Site"), you agree to use it lawfully and in accordance with these Terms. You may not:

3. Payment-processing services

Payment-processing services are subject to a separate Merchant Application and Agreement, your Program Guide, and all applicable card-network rules (Visa, Mastercard, American Express, Discover, and others). Information on this Site about rates, fees, equipment, or program features is for general informational purposes and is not a binding offer. Final terms are set out in your executed Merchant Agreement.

You are responsible for complying with all card-network rules, applicable law, and the requirements of your Merchant Agreement, including but not limited to proper disclosure requirements for dual pricing or surcharging programs.

4. Dual pricing and surcharging

360 Paymentech offers compliant dual-pricing and surcharging programs. These programs are configured at setup to comply with the disclosure, signage, receipt, and operational requirements of your state and applicable card-network rules. Savings illustrations on this Site are estimates based on typical merchant volume and mix; your actual results will depend on your specific transaction data. This is not legal advice; confirm your specific state requirements with us at setup.

5. Partner and referral program

Participation in our referral or partner program is subject to separate program terms provided at enrollment. Referral payments are made to eligible participants who are 18 years of age or older and who comply with all program requirements. Earnings are not guaranteed and depend on the merchants you refer and the program terms in effect at the time. We reserve the right to modify or terminate the program at any time with reasonable notice.

6. Client portal (GoHighLevel)

360 Paymentech uses GoHighLevel as the technology platform for client account access, 360 AI services, and related tools. When you access your client portal — at app.gohighlevel.com or a white-labeled domain — your use is also subject to GoHighLevel's Terms of Service and Privacy Policy. You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at hello@360paymentech.com if you suspect unauthorized access to your account.

7. 360 AI services

360 AI services — including AI receptionists, chatbots, websites, email and SMS marketing, CRM, automation, and reporting — are delivered through our 360 AI division and powered in part by GoHighLevel and third-party AI providers. The specific scope, deliverables, fees, and timeline for any 360 AI engagement are defined in a separate written agreement or order form. AI-generated outputs should be reviewed for accuracy before use. We do not guarantee any specific result or performance level from AI services.

You are responsible for obtaining all legally required consents before using our services to communicate with your customers, including compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any applicable state or local requirements for SMS and email marketing.

8. Intellectual property

The Site and its content — including the 360 Paymentech and 360 AI names, marks, logo, design, text, and graphics — are owned by or licensed to 360 Paymentech and are protected by United States and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Clover® and the Clover logo are registered trademarks of Clover Network, LLC; 360 Paymentech is an authorized reseller and hardware images are used under our authorized reseller program. All other third-party product names and trademarks referenced on this Site belong to their respective owners.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. INFORMATION ON THIS SITE — INCLUDING SAVINGS ESTIMATES, PRICING GUIDANCE, AND AI-GENERATED CONTENT — IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 360 PAYMENTECH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify and hold harmless 360 Paymentech and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any applicable law or card-network rule; or (d) any content or information you provide to us.

12. Governing law and disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms that is not resolved by mutual agreement will be subject to binding arbitration in Washington State under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Material changes will be communicated by email to active merchants or by a notice on the Site. Your continued use of the Site or our services after changes take effect constitutes your acceptance of the updated Terms.
