These Terms of Service ("Terms") govern your use of the 360 Paymentech website and services. By using our website or services, you agree to these Terms. If you are using the services on behalf of a business, you represent that you have authority to bind that business.
Our services
360 Paymentech provides payment processing services and a front-office platform for businesses, which may include website design and hosting, call answering and receptionist services, online booking and scheduling, customer relationship management tools, email and text messaging tools, invoicing, review management, and workflow automation. Specific services, features, and pricing for your business are set out in your service agreement, order, or proposal with us, which forms part of these Terms.
Payment processing
Payment processing is provided through third-party processors and financial institutions. 360 Paymentech is not a bank. Your use of processing services is also subject to the processor's terms, card network rules, and applicable law. Processing rates, program fees, and funding timelines described on this website are summaries only and are governed by your merchant agreement.
Fees and billing
You agree to pay the setup fees, subscription fees, and usage charges described in your service agreement or order. Subscriptions renew for successive terms unless cancelled as described in your agreement. Fees are non-refundable except where your agreement or applicable law says otherwise. We may change our prices with notice as described in your agreement.
Your responsibilities
- Provide accurate information and keep your account details current.
- Obtain any consents required before sending us customer information or asking us to contact your customers on your behalf.
- Use the services lawfully — including compliance with telemarketing, text messaging, email marketing, and privacy laws that apply to your business communications.
- Keep your account credentials secure. You are responsible for activity under your account.
Messaging terms
If you opt in to receive text messages from 360 Paymentech, you agree to receive appointment, account, and service messages, and — where separately consented — promotional messages. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
Intellectual property
Our website, branding, and platform materials belong to 360 Paymentech or its licensors. Content and materials you provide to us remain yours; you grant us the rights needed to use them to provide the services (for example, building your website with your photos and business information). Websites and other deliverables we create for you are licensed or transferred to you as described in your service agreement.
Third-party services
Our services may rely on or link to third-party platforms and providers. We are not responsible for third-party services, and your use of them is subject to their terms.
Disclaimers
Our website and services are provided "as is" and "as available," without warranties of any kind except as expressly stated in a written agreement with you. Estimates and examples shown on this website — including potential savings or revenue figures — are illustrations based on stated assumptions, not guarantees of results.
Limitation of liability
To the fullest extent permitted by law, 360 Paymentech's total liability arising out of or related to the services will not exceed the amounts you paid us for the services in the three months before the claim arose, and neither party will be liable for indirect, incidental, or consequential damages.
Indemnification
You agree to indemnify and hold harmless 360 Paymentech from claims arising out of your use of the services, your business communications, or your violation of these Terms or applicable law.
Termination
Either party may terminate services as described in the applicable service agreement. We may suspend or end access if these Terms are violated. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules.
Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the services after an update means you accept the updated Terms.
